{"id":527,"date":"2021-11-14T15:25:49","date_gmt":"2021-11-14T15:25:49","guid":{"rendered":"https:\/\/forework.com\/?p=527"},"modified":"2022-12-24T15:26:40","modified_gmt":"2022-12-24T15:26:40","slug":"employers-who-electronically-monitor-employees-must-now-notify-their-employees-of-the-monitoring","status":"publish","type":"post","link":"https:\/\/forework.com\/employers-who-electronically-monitor-employees-must-now-notify-their-employees-of-the-monitoring\/","title":{"rendered":"Employers who Electronically Monitor Employees Must now Notify their Employees of the Monitoring"},"content":{"rendered":"\n<p><br>Employers who reserve the right to view employees&#8217; email and other electronic communications must comply with a new NY law.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"717\" src=\"https:\/\/forework.com\/wp-content\/uploads\/2022\/12\/blog4-1024x717.jpeg\" alt=\"\" class=\"wp-image-529\" srcset=\"https:\/\/forework.com\/wp-content\/uploads\/2022\/12\/blog4-1024x717.jpeg 1024w, https:\/\/forework.com\/wp-content\/uploads\/2022\/12\/blog4-300x210.jpeg 300w, https:\/\/forework.com\/wp-content\/uploads\/2022\/12\/blog4-768x538.jpeg 768w, https:\/\/forework.com\/wp-content\/uploads\/2022\/12\/blog4.jpeg 1100w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure><\/div>\n\n\n<p>On November 8, 2021, Governor Hochul signed legislation amending the State civil rights law to add a new provision requiring employers who engage in electronic monitoring to notify workers of such.The amendment (<a href=\"http:\/\/legislation.nysenate.gov\/pdf\/bills\/2021\/S2628\">A.430\/S.2628<\/a>), which takes effect 180 days after the governor\u2019s signature, applies to any private employer with a place of business in New York that \u201cmonitors or otherwise intercepts\u201d any employee\u2019s telephone conversations, emails, or internet access or usage by \u201cany electronic device or system.\u201d<\/p>\n\n\n\n<p>Under the new provision, a private employer who engages in such monitoring of employees must give prior written notice upon hire to all employees who are subject to electronic monitoring. This notice must be in writing or in an electronic record, and must be acknowledged by the employee in writing or electronically.<\/p>\n\n\n\n<p>Employers must also post the notice of electronic monitoring \u201cin a conspicuous place which is readily available for viewing by its employees who are subject to electronic monitoring.\u201d<\/p>\n\n\n\n<p>The contents of the notice must advise employees that:<\/p>\n\n\n\n<p>\u201c[A]ny and all telephone conversations or transmissions, electronic mail or transmissions, or internet access or usage by an employee by any electronic device or system, including but not limited to the use of a computer, telephone, wire, radio or electromagnetic, photoelectronic or photo-optical systems may be subject to monitoring at any and all times and by any lawful means.\u201d<\/p>\n\n\n\n<p>The amendment additionally imposes fines on employers violating the new requirement: a maximum of $500 for the first offense, $1,000 for the second offense, and $3,000 for the third and each subsequent offense.<\/p>\n\n\n\n<p>In addition to providing and posting the notice as required, any private employer with a place of business in New York is advised to add an additional policy to their handbook in response to this new requirement.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Employers who reserve the right to view employees&#8217; email and other electronic communications must comply with a new NY law.
